Your ability to participate in competitions or use services offered by third-party developers does not make ByteForge Tech Limited (referred to as "we", "us", or "our") the provider of these competitions or services. We act solely as a platform connecting users with third-party developers and their offerings, and this distinction defines our respective responsibilities.
BY REGISTERING FOR AN ACCOUNT ("Account"), USING OUR SERVICES, CLICKING "I ACCEPT", DOWNLOADING ANY APPLICATION, OR REGISTERING FOR/PARTICIPATING IN COMPETITIONS, YOU: (A) ACKNOWLEDGE HAVING READ THESE TERMS AND CONDITIONS, ANY POLICIES INCORPORATED HEREIN, AND THE RULES OF INDIVIDUAL COMPETITIONS (collectively, the "Terms") IN FULL; (B) AGREE TO BE BOUND BY THESE TERMS; AND (C) CONFIRM YOU ARE AUTHORIZED TO ACCEPT THEM.
This action forms a legally binding agreement. By proceeding, you confirm you understand the Terms, which govern your use of our platform, and that you have the legal capacity to enter this agreement.
a. License to Access and
Use
Subject to your ongoing compliance with these Terms, we grant you a personal, non-exclusive,
non-transferable, non-sublicensable, revocable, limited license to access and use our Platform and
its Content via a supported web browser or mobile device—solely for personal, private
entertainment.
This license restricts use to your individual enjoyment and prohibits commercial use, sharing,
transfer, or sublicensing to others. We reserve the right to revoke this license if you violate the
Terms.
b. Avatar
License
We grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable, limited
license to use avatars available on the Platform, subject to the same restrictions as the general
license above. Avatars may only be used within our platform for personal purposes.
c. Amendments to
Terms
We may modify the Terms at any time. Material changes will be posted on our website, and the "DATE
LAST MODIFIED" at the top reflects the most recent update. Your continued use of our services after
changes are posted constitutes acceptance of the revised Terms. It is your responsibility to review
the Terms periodically.
d. Written
Modifications
No changes to these Terms are valid unless agreed to in a formal written document signed by both
parties. For purposes of this clause, "writing" does not include emails or electronic/facsimile
signatures.
e. Eligibility
Requirements
To register an Account, participate in competitions, use services, or download software, you
must:
Be a natural person aged 18 or older, with a personal email address used for registration;
Have the legal capacity to enter into a contract;
Be physically located in a jurisdiction where the selected competition is legally permitted;
Comply with these Terms at all times.
Failure to meet these requirements may result in account suspension or closure, with or without
notice.
a. Age and Legal
Requirements
You confirm you are at least 18 years old (or the higher age of majority required by your
jurisdiction) and legally permitted to participate in the games offered on the Platform under
applicable laws.
b. Gaming Laws
Acknowledgment
Participation in competitions with entry fees or prizes is governed by varying "Gaming Laws" in each
U.S. state, country, or territory. Our software prohibits access to cash competitions in
jurisdictions where they violate local laws ("Prohibited Jurisdictions"). If you are in a Prohibited
Jurisdiction, you may not participate in cash competitions.
c. Prohibited
Jurisdictions
As of the last modified date, Prohibited Jurisdictions in the U.S. include: Arkansas, Delaware,
Indiana, Louisiana, Maine, South Carolina and South Dakota.
It is your responsibility to verify if your location is a Prohibited Jurisdiction. We reserve the
right to monitor locations and block access from prohibited areas. You must accurately confirm your
location each time you participate in a cash competition.
d. Personal Capacity
Participation
You participate in games solely in your personal capacity for recreational and entertainment
purposes.
e. Personal
Representation
You participate on your own behalf and not as a representative of any other person.
f. Information
Accuracy
All information you provide must be true, complete, and correct. You agree to immediately notify us
of any changes to your information.
g. Fair Play
Requirements
You must not engage in fraudulent, collusive, or unlawful activity related to game participation.
Use of automated software (e.g., bots), hardware devices, or other unfair methods is strictly
prohibited. We reserve the right to invalidate your participation if such behavior is detected.
h. Merchandise
Restrictions
You may not sell, trade, or attempt to sell/trade any merchandise provided by us for value.
a. Single Account
Limitation
You are permitted only one Account (including inactive accounts). Attempting to open multiple
accounts may result in suspension or closure of all associated accounts.
b. Multiple Account
Notification
If you discover you have multiple accounts, notify us immediately. Do not create a new account to
update details (e.g., email, address); use your existing account's update features instead.
c. Account Security
Responsibility
You are solely responsible for securing your Account login details and payment methods, ensuring
only you can access them. You accept full liability for unauthorized use of your Account.
d. Account and
Children
You are responsible for all activity linked to your Account, including use by minors (which is
strictly prohibited).
e. Account Sharing
Prohibition
You must not share your Account or password, allow others to access it, or take actions that
compromise its security.
f. Security Compromise
Notification
Notify us immediately if you suspect your Account security has been compromised (e.g., loss, theft,
or unauthorized disclosure of login details).
g. Password
Confidentiality
You alone are responsible for maintaining password confidentiality and all activities conducted
through your Account.
h. Account Activity
Responsibility
You are liable for all actions performed through your Account, whether or not you authorized them.
Your Account may be terminated if others use it to violate these Terms or engage in illegal
activity.
i. Third-Party Abuse
Liability
We are not responsible for Account misuse by third parties resulting from your intentional or
accidental disclosure of login details.
j. Inactive Account
Closure
We reserve the right to close accounts deemed inactive.
k. Inactive Account
Balance
If no transactions occur on your Account for 30 consecutive months, we will remit any remaining
balance of redeemed prizes to you, as required by applicable law.
a. Fees
Fees for participating in competitions and billing procedures are detailed in the billing
application. By accepting fees charged to your Account, you agree to pay them. All fees are in U.S.
Dollars, prepaid, and non-refundable. You are responsible for all charges (including unauthorized
ones) under your Account. Prices may change at any time but will not affect past purchases.
b. Billing
As agent for our developer partners, we may modify fees and billing procedures by updating the
billing application (with or without notice). By providing a payment method, you:
Confirm you are authorized to use it and that payment details are accurate;
Authorize us to charge you for services and paid features via this method.
Billing may occur in advance, at purchase, or shortly after purchase. You must report billing errors
within 120 days of their appearance for investigation; after this period, no corrections or refunds
will be provided. We will correct errors we identify within 90 days. You are liable for all costs
(including legal fees) to collect past-due amounts.
c. Cash Deposits
"Non-Cash Players" participate in competitions without depositing U.S. Dollars.
"Cash Players" participate in competitions requiring entry fees in U.S. Dollars and must maintain
current, accurate information (full name, address, phone number, payment details).
Cash Players consent to sharing personal/payment information with third-party service providers for
identity verification, transaction risk assessment, and other purposes outlined in our Privacy
Policy.
d. Bonus Funds
Cash Players may receive "Bonus Funds" for use in cash competitions (not for withdrawal). Bonus
Funds are applied at a rate of $0.01 for every $0.10 spent on entry fees. If only Bonus Funds are
available, they will be used for entry. Winnings from Bonus Fund entries return the used Bonus
Funds, with additional winnings paid in U.S. Dollars. Bonus Funds are forfeited if:
You withdraw funds from your Account;
You do not enter a cash competition for 60 consecutive days.
e. Withdrawals
Cash Players may request withdrawals of available funds. Digital Assets and Bonus Funds are
non-withdrawable. Withdrawals are processed via check or refund to your original payment method,
taking up to 90 days. We may freeze accounts or delay withdrawals during investigations, eligibility
verification, or to comply with laws. A processing fee may apply to check withdrawals.
f. Refund Policy
No refunds are provided unless required by law.
g. Winnings
To receive winnings, you may be required to provide proof of eligibility and compliance with these
Terms. Failure to provide satisfactory proof will result in forfeited winnings. Erroneous payments
may be reversed or required to be returned, and we may adjust future payments to correct
overpayments.
h. Credit Card/PayPal
Use
You must be the authorized user of any credit card or payment method (e.g., PayPal) used. Notify us
promptly of changes to payment details. Unauthorized use of payment methods is your responsibility.
Fraudulent use will result in immediate account termination, forfeited winnings, and potential legal
action.
a. DMCA
Compliance
To report copyright infringement under the Digital Millennium Copyright Act (DMCA), contact our
designated agent with:
A physical/electronic signature of the copyright owner or authorized representative;
Description of the infringed work;
Location of the allegedly infringing material on our platform;
Contact information for the complainant;
A statement of good-faith belief that the use is unauthorized;
A statement (under penalty of perjury) confirming the accuracy of the information and authorization
to act on the owner's behalf.
b. Your Content
You grant us a worldwide, perpetual, unrestricted, royalty-free license to use, copy, modify,
distribute, publish, perform, and display any content you submit ("Content"), waiving all moral
rights. Content is treated as non-confidential and non-proprietary. We may use Content for any
purpose without compensation. You warrant that you own all rights to Content and that its use
complies with laws. Terminated accounts may have Content permanently deleted without return.
This Agreement and any disputes arising out of or relating to it shall be governed by and construed in accordance with the laws of the State of Nevada, United States, without regard to its conflict of law principles.
Any controversy or claim arising out of or relating to this Agreement, or the breach thereof, shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The seat of arbitration shall be Las Vegas, Nevada, and the language of the arbitration shall be English. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
You agree to resolve disputes on an individual basis and waive any right to participate in class, consolidated, or representative actions.
Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.
We reserve the right to modify this "Governing Law and Dispute Resolution" section. Continued use of the Services after changes constitutes acceptance of the updated terms.
